Gifts of Land or Property
Landowners who wish to help NYALT step up the pace of farmland conservation can give their land (or a portion of their land) directly to NYALT. Our land trust can accept gifts of forestland, houses, or other property to help further its farmland protection efforts.
Unlike the donation of an agricultural easement (where the landowner still owns his/her land), a gift of land would transfer full ownership of the property to NYALT.
What are the possible tax benefits?
- Estate planning: A gift of land to NYALT could help lower your estate taxes. You can give land away as part of your Will, or in conjunction with a life estate that would allow you to live on the property during your lifetime.
- Federal and state income tax deduction: There may be significant tax benefits for donating land or property. Click here for more information.
- Reduces property taxes: If you give some, or all, of your land to NYALT, you will no longer be responsible for the property taxes. Instead, the new owner (when NYALT sells it to a farmer or new landowner) would be responsible for these taxes.
What happens to the land if I give it to NYALT?
- Farmland: If the donated land is high-quality farmland, NYALT would conserve the land with an agricultural easement before selling it to another landowner. All proceeds would be applied to NYALT’s farmland protection program.
- Non-farmland: If the land did not qualify for an agricultural easement, NYALT would see if another conservation group would be interested in conserving it, and if so, work with that group before selling the property. Again, all proceeds would go towards NYALT’s farmland protection work.
